Property Separation In Divorce Attorney GA

Assets or debts that either spouse had before your marriage, or acquired after the permanent separation, are considered separate property or debts. Generally, each spouse will keep their separate property and be responsible for their separate debts. If both spouses can agree on how to divide marital property, the court will simply approve agreement. If the spouses can’t agree, the court will divide the property.
Marital property generally includes the following:
• A home if purchased with earnings of either or both parties, if earned during the marriage.
• A pension plan, to the extent accrued during the marriage.
• The value of bank accounts, mutual funds, etc., at least to the extent the funds deposited were earned by either party during the marriage.
• Bank accounts from before the marriage that, upon marriage, were re-titled to joint names.
• A home purchased before the marriage that, during the marriage, was re-titled to joint names.
Separate property is any of the following:
• Property a party owned before the marriage.
• Property a party acquired during the marriage by gift or inheritance.
• Income from either of these.
• Property acquired with separate property funds during the marriage and labeled explicitly as separate property.
• Earnings, gains, or winnings earned or received after the separation date.
