No fault divorce in Columbus Georgia – No fault Muscogee County GA

No fault divorce law eliminates requirement of "proof of fault" by providing for the dissolution of a marriage on a finding that the relationship is no longer viable.

A divorce formally dissolves a legal marriage. Divorce in United States is governed by state law. Generally certain residency requirements must be fulfilled before a divorce petition can be filed. In order to file for a divorce in Georgia, residency requirements must be met for the court to accept the case. If the court discovers it does not have jurisdictional rights to hear the case it will not be accepted or it will eventually be dismissed.

Georgia permits 'irreconcilable differences' type of no fault divorces as well as fault divorces. You must live in Georgia for 6 months before you can obtain a divorce. If you live out of state, you may file against a Georgia resident. There is no legal separation period required, and the divorce may be filed on the date of separation. Also, the parties may be considered separated for the purpose of divorce and still live in the same house.

To obtain a no fault divorce, one party must establish that he or she refuses to live with the other spouse and that there is no hope of reconciliation. Both parties need not agree that the marriage is irretrievably broken. There is no requirement to show that there was any fault or wrongdoing by either party.
