Columbus Georgia Family Lawyer – GA Divorce Residency Requirements
Georgia has strict residency requirements for divorce filings. You must meet the residency requirements if you want to file for divorce in Georgia. The residency requirements are provided in the Georgia Code Sections 19-5-5.
The divorce process starts with the filing of the divorce complaint. In Georgia, the divorce compliant must be filed in the superior court having jurisdiction over the place of residence of the other spouse. If the other spouse no longer resides in Georgia, the complaint can be filed in the superior court having jurisdiction over the place of residence of the spouse residing in Georgia.
After the compliant is filed, the court will send notice of the divorce compliant to the other spouse who then has to file a reply to the compliant. Either spouse may request a temporary hearing where issues of child custody, visitation, child support, alimony, debts and possession of property may be resolved on a temporary basis until final resolution. The judge will issue a temporary order that applies only until the time of the final trial. The temporary order may also prohibit the transfer or selling of assets, or prevent one party from interfering with the other party, or from interfering with the party's children.
